"plague of lawsuits"?
Former California Governor Pete Wilson decried a "plague of lawsuits" and
claimed that in 1991, there were seven lawsuits filed every minute of every hour
of every working day in the year. Rhetoric aside, the cold hard facts for
California are the following:
| Type of Lawsuit |
Year |
Number |
|
| Personal Injury |
1983-84 |
96,731 |
| |
1992-93 |
88,345 |
| |
1996 |
43,000 |
| (These are all one year periods.) |
Thus, you can see that there is not a glut of lawsuits clogging our courts
compared to ten years ago.
Moreover, personal injury jury trials numbered 1,800 in the State of California
in 1994-95, down 14% from the previous reporting period. In 1994-95, there were
8,882,123 cases filed in all courts, down 5% from the previous reporting period.
Thus only 1,800 jury trials resulted from the nearly 9 million cases filed.
Meanwhile, Superior Court civil petitions, cases involving child support,
domestic violence, adoption, etc., dramatically escalated 24%. Insurance
companies and corporations are not advocating limiting family law cases, they
want only to limit personal injury actions so the insurance companies and
corporations will not have to take responsibility.
